Terms and Conditions & Delivery Terms PrikPrak

Article 1. Definitions

In these Terms and Conditions, the following terms shall have the following meanings:

• PrikPrak: De onderneming PHKemper Marketing, gevestigd te Victoriapark 850, 5611 BN Eindhoven, ingeschreven bij de KvK onder nummer 17236305, exploitant van de applicatie PrikPrak.
• User: The natural person (consumer) who has created an account on PrikPrak and/or uses the Service.
• Service: The Software-as-a-Service (SaaS) application PrikPrak, focused on recipe management, meal planning, (AI) meal suggestions, recipe import, and supermarket price comparison.
• Agreement: The agreement between PrikPrak and User providing access to and use of the Service.
• Freemium Account: Het gratis account waarmee Gebruiker toegang krijgt tot de basisfunctionaliteiten van de Dienst (inclusief behoud van reeds opgeslagen recepten tot maximaal 15 actieve nieuwe toevoegingen).
• Premium Subscription: The paid subscription (monthly or yearly) granting the User access to advanced and exclusive features.
• Mollie: The Payment Service Provider processing payments and recurring direct debits on behalf of PrikPrak.

Article 2. Applicability

1. These Terms and Conditions apply to every offer by PrikPrak, the conclusion of the Agreement, any use of the Service, and all resulting agreements.

2. By creating an account or taking out a Premium Subscription, the User agrees to these Terms and Conditions.

3. PrikPrak reserves the right to unilaterally amend these terms. Changes will be announced via the application or email at least 30 days prior to taking effect.

Article 3. Registration and Account Management

1. To use the Service, the User must create a personal account. The User guarantees that all information provided during registration is correct, complete, and current.

2. The account is personal and non-transferable. The User is responsible for maintaining the confidentiality of login credentials.

3. PrikPrak reserves the right to refuse, suspend, or terminate accounts if the User violates these terms.

Article 4. Offer, Subscriptions, and Delivery

1. PrikPrak offers a Freemium (free) functionality and a Premium (paid) subscription.

2. Delivery of the Service is fully digital (SaaS). Upon registration or payment, the User receives instant access to the respective features.

3. PrikPrak strives to maintain 24/7 availability of the Service, but does not guarantee uninterrupted or error-free operation.

Article 5. Prices, Payments, and Direct Debit (Mollie)

1. All listed prices are in euros (€) and include statutory VAT.

2. Betalingen geschieden via de betalingsdienstaanbieder Mollie B.V. (waaronder iDEAL, Wero, creditcard en Automatische Incasso).

3. De eerste betaling van het Premium Abonnement wordt voldaan via de gekozen online betaalmethode. Door het afsluiten van een periodiek abonnement geeft Gebruiker een doorlopende machtiging aan PrikPrak en Mollie B.V. om volgende termijnen (maandelijks of jaarlijks) automatisch te incasseren.

4. Kortingscodes geven gedurende de aangegeven looptijd en het vastgestelde percentage korting op de abonnementsprijs. Na afloop van de kortingsperiode vervalt de korting en wordt het reguliere tarief in rekening gebracht.

5. Voorafgaand aan elke automatische incasso (verlenging) ontvangt de Gebruiker minimaal één week van tevoren een aankondigingsmail (pre-notification). Deze e-mail bevat tevens een directe link waarmee de Gebruiker het abonnement eenvoudig kan stoppen.

6. Indien een automatische incasso mislukt of wordt gestorneerd, heeft PrikPrak het recht om de toegang tot de Premium functionaliteiten tijdelijk op te schorten tot de betaling is voldaan.

Article 6. Duration, Cancellation, Renewal, and Fallback to Freemium

1. A Premium Subscription is entered into for a fixed period of one month or one year.

2. Upon expiration of the initial term, the subscription automatically renews for consecutive equal periods unless cancelled in a timely manner.

3. Opzegging kan op elk moment via de accountinstellingen in de PrikPrak-applicatie of via de opzeglink in de aankondigingsmail. Opzegging dient uiterlijk 24 uur vóór het einde van de lopende abonnementsperiode te geschieden.

4. Na opzegging behoudt de Gebruiker volledige toegang tot de Premium functionaliteiten tot het einde van de reeds betaalde abonnementsperiode.

5. Na het verstrijken van de betaalde periode valt het account automatisch terug naar een Freemium Account. Reeds opgeslagen recepten (ook indien dit er meer dan 15 zijn) blijven behouden in het account; het is echter pas weer mogelijk nieuwe recepten toe te voegen zodra het totaal aantal onder de freemium-limiet van 15 daalt of bij een nieuwe upgrade.

6. Er vindt geen restitutie plaats van reeds betaalde abonnementsgelden.

Article 7. Right of Withdrawal (Cooling-off Period)

1. As PrikPrak constitutes a digital Service delivered immediately upon payment, the User explicitly consents to immediate performance of the Agreement upon subscribing.

2. The User acknowledges losing the statutory right of withdrawal (14-day cooling-off period) once the digital delivery has commenced.

Article 8. Supermarket Prices, Recipes, and AI Features

1. PrikPrak utilizes automated systems and AI integrations to retrieve ingredient prices, store layouts, and meal suggestions.

2. PrikPrak cannot guarantee that supermarket prices are 100% accurate or up-to-date at all times. Physical in-store prices always take precedence.

3. PrikPrak is not responsible for allergic reactions or dietary errors resulting from preparing suggested or imported recipes. The User remains solely responsible for checking ingredients.

Article 9. Liability and Disputes

1. De totale aansprakelijkheid van PrikPrak is beperkt tot vergoeding van directe schade tot maximaal het bedrag dat Gebruiker in de 3 maanden voorafgaand aan de gebeurtenis aan PrikPrak heeft betaald.

2. Agreements between PrikPrak and the User are exclusively governed by Dutch law.
